An application for divorce is only required if the parties are legally married. In order to make an application for divorce, you must be separated for a minimum of 12 months, as the Court needs to be satisfied that the relationship has broken down irretrievably. Separation occurs when you and your spouse stop living together as a couple, although it does not necessarily mean one of you moving out of the home. This is often referred to a separation under the same roof. An application for divorce can be made by one party without the consent of the other party or jointly.
